Les comportements accomplis dans l’exercice de leurs fonctions par les organes et agents des organisations internationales étant attribuables à ces dernières, les définitions de ces notions conditionnent largement l’étendue de la responsabilité de telles organisations. Pourtant, les efforts de la Commission du droit international pour dégager quelques éléments d’identification à partir d’une pratique balbutiante ont soulevé autant d’interrogations qu’ils en ont résolues. Certaines questions ont ainsi été abordées sans être définitivement tranchées, telles que celles du détachement d’organes étatiques auprès des organisations ou de la participation de leurs membres à la mise en oeuvre de leurs actes, d’autres ont été négligées, telles que celles que posent les pratiques de l’externalisation et des partenariats ou encore le dynamisme institutionnel des organisations. Les définitions retenues sont certes suffisamment larges pour saisir l’ensemble des moyens d’action des organisations internationales. Mais leur imprécision risque de laisser l’interprète quelque peu démuni à l’heure d’identifier in concreto les comportements susceptibles d’engager la responsabilité des organisations.

According to the International Law Commission, “the conduct of an organ or agent of an international organization in the performance of functions of that organ or agent shall be considered an act of that organization under international law” (article 6 DARIO). Thus, the definitions of the concepts of “organ” and "agent” play a critical role in the determination of the scope of responsibility of an international organization (IO). Admittedly, those concepts appear to be comprehensive enough to include all means of actions at the disposal of IOs. But the details provided by the Commission on this important topic are sometimes confusing. Important questions, such as those raised by the participation of IOs’ members to their activities, were discussed at length without being settled. Others, such as those linked to the practice of externalization or to the institutional dynamism of IOs, were neglected.
