Le Traité Benelux signé en 2008 doit donner un nouveau souffle à l’organisation, que la crise d’identité guettait à mesure des développements de l’intégration européenne. La coopération entre les trois États est désormais orientée vers des domaines précis d’activité. L’occasion a été saisie pour moderniser en outre les institutions conçues en 1958, et les adapter à la structure fédérale de la Belgique. Le Benelux se voit également reconnaître une personnalité juridique internationale qui lui faisait jusqu’alors défaut, ainsi que la compétence de nouer des relations extérieures de natures diverses. Ses privilèges et immunités, comme ceux de ses agents, sont, enfin, considérablement précisés. L’ensemble de la réforme n’est pas sans susciter plusieurs questions d’ordre technique, s’agissant notamment du statut juridique des instruments accompagnant le Traité de 2008, de la «succession» à l’Union Benelux primitive ou de la responsabilité internationale dont les États membres entendent s’exonérer.

The Benelux Treaty signed in 2008 is intended to give the Benelux organization a second wind, and to avert the threat of an «identity crisis» that might have resulted from the European integration process. Henceforth the cooperation between the three States is directed towards specific areas. Moreover, the opportunity has been seized upon to modernize the institutions created in 1958, and to adapt them to the federal structure of Belgium. The Benelux has also eventually been granted international legal personality, as well as the power to enter into external relations of various types. Lastly, the privileges and immunities of both the international organization and its agents have been significantly clarified. As a whole, the reform does not go without raising several technical issues, with respect to, among others, the legal status of the instruments accompanying the 2008 Treaty, the «succession» to the initial Benelux Union, or the exclusion of international responsibility asserted by the Member States.
